A hero cop whose NYPD career went up in smoke after his wife allegedly spiked his meatballs with marijuana has lost his bid to get his job back.

Anthony Chiofalo had contended that Commissioner Ray Kelly’s decision to end his 22-year career over the single failed 2005 drug test was “arbitrary, capricious, unreasonable and unconstitutional.”

But a state appellate-court ruling yesterday upheld Kelly, who had cited evidence “that inadvertently ingesting marijuana in contaminated food and inhaling secondhand smoke could not cause the high levels of marijuana in petitioner’s hair samples.”
