
A tech entrepreneur can sue People magazine for misidentifying her in a photo as Google co-founder Sergey Brin’s mistress, a Manhattan judge has ruled.
The September 2013 article “Billion-Dollar Breakup?” ran an image of businesswoman Nathalie de Clercq with a caption identifying her as Google staffer Amanda Rosenberg, Brin’s gal pal.
The two women are unrelated, although they have similar physical attributes.
A photographer had snapped De Clercq while she was cycling and wearing Google Glass, an accessory also favored by Rosenberg.
People tried to get the $4 million suit tossed, arguing that the article didn’t harm De Clercq’s reputation.
In an interim ruling released this week, Manhattan Supreme Court Justice Anil Singh disagreed with People’s argument.
A People spokeswoman said, “We cannot comment on ongoing litigations.”
The parties are due in court in June.
