Former Department of Investigation Commissioner Mark Peters shouldn’t have to testify in a civil case brought by moms who claim their kids were poisoned by lead in ­NYCHA housing, city lawyers say.

The subpoena was served on Peters in November by the lawyer for three women who brought the Manhattan federal lawsuit.

But city lawyers say DOI Inspector General Ralph Iannuzzi should be called instead of Peters, because Iannuzzi gave Peters the information he needed for the November 2017 report that revealed former NYCHA Chairwoman Shola Olatoye didn’t conduct mandatory apartment inspections and then lied about it to the feds.
