The first Guantanamo Bay detainee being prosecuted in civilian court will be examined by a retired Army shrink to find out if he’s fit for trial in the 1998 al Qaeda bombings of two American embassies in Africa.

In a ruling filed this morning, a judge also ordered that accused al Qaeda henchman Ahmed Khalfan Ghailani undergo questioning to determine if he’s “competent to waive his right to be present” in court.

The former bodyguard to Osama bin Laden has said he’d rather stay in solitary confinement at the downtown Metropolitan Correctional Center than undergo routine strip searches before and after trips to court.

Ghailani’s exam will be conducted by Dr. Gregory Saathoff, a University of Virginia professor who’s worked with the FBI and last year said that alleged al Qaeda associate Aafia Siddiqui was “most likely” faking mental illness to avoid trial for trying to kill American personnel in Afghanistan.

Manhattan federal Judge Lewis Kaplan directed Saathoff to file his report by June 21.
