An ex-detective with a New York Harbor anti-corruption agency won’t go to prison after being convicted of lying about giving a colleague a leg up on a job exam.

James Sutera was sentenced Wednesday to five years’ probation. His lawyer, John Patten, says Sutera maintains his innocence and plans to appeal.

The 29-year-old was a detective with the Waterfront Commission of New York Harbor. He was convicted in June of perjury. Jurors found he lied about having provided a would-be detective with materials used to create a test for the position.

The Waterfront Commission was created in 1953 to deter criminal activity reflected in the film “On the Waterfront” and to ensure fair hiring at the Port of New York and New Jersey.
