The former Brooklyn sex crimes prosecutor accused of sexually assaulting a Daily News reporter testified Tuesday that the encounter was consensual.
“I asked to kiss her, she smiled at me and I leaned to my left and kissed her twice on the lips,” Chrismy Sagaille told jurors of the April 2017 incident.
The woman, whose name is being withheld by The Post, accuses the former Assistant DA of forcibly kissing her and grabbing her breast as she gave him a lift home from an acquaintance’s baby shower.
“I did not grab her breast,” he testified, and said he “never” kissed her against her will.
“She stopped at the red light, looked at me, tapped my hand, touched my hand. We had a lighthearted conversation,” said Sagaille, who was canned by the Brooklyn DA’s office following the allegations.
Sagaille’s father was rebuked in court Monday for allegedly drawing his finger across his throat in an attempt to intimidate his son’s accuser as she testified.
Sagaille was acquitted in 2017 of drunk driving, and has two other sealed arrests.
