Disgraced former state Sen. Pedro Espada’s bid to overturn his 2013 conviction and five-year sentence for looting his tax-funded nonprofit was tossed by a federal appeals court Monday.

Espada argued that the judge in his Brooklyn case should have given him a new trial because the jury that convicted him used evidence not admitted at trial.

But the Court of Appeals for the 2nd Circuit shot him down.
