A “devastated” family whose father and daughter were left seriously injured by a hit-and-run driver on Staten Island is planning to sue the city for $101 million, The Post has learned.

Guy Seth and his 6-year-daughter were mowed down as they crossed the street in January by Staten Island pediatrician Sam Leuzzi, who was charged with leaving the scene of an accident, authorities said.

Leuzzi, 66, drove his black GMC truck into Seth, 52, and his daughter, Zoey, who was sitting on her dad’s shoulders while crossing the busy Arthur Kill and Drumgoole roads in Greenridge Jan. 9, police said.

The little girl fractured her skull, requiring surgery, and the father suffered a “catastrophic, traumatic brain injury,” said family attorney Ravi Batra, who filed a notice of claim against the city.

Leuzzi is not named in the pending suit.

The claim alleges the city Department of Transportation “negligently designed and created the dangerous intersection of Arthur Kill Road and Drumgoole [Road] West.”

Batra told The Post that the intersection was “known for years to be defective and deadly, by having a disappearing green arrow to control two left-turn lanes on Arthur Kill Road on to Drumgoole Road West.”

Batra said Seth, who earned nearly $300,000 a year before COVID as a waiter at the Waldorf Astoria and later worked for the city in maintenance, is now “virtually homebound” while Zoey “has a titanium plate in her head.”

The city’s Law Department declined to comment on the claim.

Leuzzi was arrested in January on a misdemeanor for not reporting the accident, cops said. He pleaded not guilty and was released on his own recognizance.

That case is pending.
