Federal prosecutors are presenting evidence to a grand jury to determine if Eric Garner’s civil rights were violated during his deadly 2014 encounter with police, sources said.
A litigator from the Department of Justice has joined two Brooklyn federal prosecutors in a case that could lead to an indictment of officers or others involved in the fatal take-down of Garner, according to law enforcement sources.
Two NYPD cops who witnessed Garner’s death were called before the grand jury Wednesday, sources said.
Garner died in July 2014 after pleading “I can’t breathe” while Officer Daniel Pantaleo tried to subdue him with a chokehold on the sidewalk of a Staten Island street corner.
Garner’s death was later ruled a homicide by the city Medical Examiner’s Office.
The presentation of evidence is the latest move in a year-long federal investigation into the fatal incident.
A grand jury on Staten Island declined to indict Pantaleo on criminal charges in Garner’s death.
