The Fashion Institute of Technology is pitching a fit over a dirty deli across the street recently renamed “the FIT Market.”
A lawsuit filed yesterday accuses the store of trademark infringement and unfair competition and seeks a court order forcing it to abandon the moniker.
The Manhattan federal court filing blasts the FIT Market for racking up 24 health-code violations, including for the apparent presence of roaches and mice, during a city inspection in May.
A manager at the market — which allegedly ignored two cease-and-desist letters — declined to comment.
