Lawyers for a New Yorker charged with supporting al Qaeda can take testimony from a Guantanamo Bay detainee who was allegedly one of Osama bin Laden’s top deputies in Afghanistan, a judge ruled yesterday.

Manhattan federal Judge Loretta Preska said the questioning of Abd al Hadi al-Iraqi would be “limited to the events associated with the charges currently pending against” Syed Hashmi, an ex-Queens man charged with conspiring to supply al Qaeda in Afghanistan with gear.

It’s not clear from the ruling what al-Iraqi knows about the case, if anything.
