Gov. Kathy Hochul on Tuesday began making up for what her disgraced predecessor failed to do — by ordering a special session of the state legislature to consider extending the eviction moratorium and her picks to regulate legal marijuana production and sales.
The session is set to start Wednesday at noon.
Hochul said she expected lawmakers to set a new, Jan. 15 end to pandemic-related rent protections following the US Supreme Court’s ruling last week that struck down a 60-day extension ordered by the Centers for Disease Control and Prevention earlier this month.
“Under my watch here in the state of New York, we’re not going to exacerbate what is already a crisis in terms of the homelessness problem,” Hochul said during an evening news conference in Albany.
“We are not going to allow people to who, through no fault of their own, lost income, [are] not able to pay and facing eviction. We’re not going to allow that to happen here in the great state of New York.”
In a clear shot at ex-Gov. Andrew Cuomo — who stepped down last week amid a sexual harassment scandal — Hochul added: “We’re not going to abandon our neighbors in need, especially — especially — since the state of New York failed in its responsibility to get the money that was allocated by Congress, out to the people in need earlier this summer.”

AP Photo/Mary AltafferCuomo repeatedly came under fire for botching the disbursement of $2.6 billion in federal funding for cash-strapped tenants, with US Senate Majority Leader Chuck Schumer calling the program a “mess” and its head testifying last week that Cuomo never even discussed the matter with him.
When asked by The Post how extending the rent moratorium into next year could survive a threatened legal challenge by the Rent Stabilization Association, a landlord industry group, Hochul said, “We’ll make it as airtight as we can.”
“Our legal team is working together right now to identify all the restrictions and the shortcomings that were determined by the Supreme Court,” she said.
In a prepared statement, Rent Stabilization Association president Joseph Strasburg said, “Governor Hochul understands the severity of the financial devastation that has plagued landlords throughout this pandemic, and while we are hopeful that she will not allow politics to drive the actions of Albany lawmakers, we reiterate our intention to seek all legal remedies if the legislation is contrary to the recent SCOTUS decision.”
Hochul also criticized Cuomo, albeit without naming him, when she said she wanted “to jumpstart the long-overdue decisions pertaining to establishing cannabis in the state of New York.”
“I’ll be [announcing] my nominations to start the process to legally produce and distribute cannabis in the state of New York,” she said.

But I’m going to make up for that lost time.”
The growing and sale of recreational marijuana, which was legalized as part of the state’s $212 billion budget deal for fiscal 2022, is expected to generate as much as $350 million a year in revenues for the state.
Hochul said she also wanted the legislature to reapprove special, pandemic-related provisions to the state Open Meetings Law to “safely allow people to participate remotely.”
“I’ve heard from too many elected officials at the county and local levels that they just want this in place, while we are still in the throes of a pandemic, to ensure that people…with disabilities and others can engage and participate in local government remotely,” she said.
“This is temporary, but it’s something that is, again — we’re not through the pandemic yet. We have to recognize that a lot of initiatives put in place last year have expired, and we have to take this action to reactivate them.”
