ALBANY — Typical Albany horse-trading shouldn’t apply when it comes to expanding the state’s DNA databank, Gov. Cuomo said yesterday.

But Cuomo said he’s open to including more DNA-related protections for suspects and defendants to get the bill passed.

Assembly Democrats are said to want any DNA expansion included in comprehensive criminal-justice legislation.

That would be “a mistake,” Cuomo told a Capitol news conference packed with prosecutors, police and crime victims supporting his bill.

The measure, already passed by the Senate, would require DNA samples from anyone convicted of any felony and any penal-law misdemeanor.
