The lawyer for the man accused of killing college football star Mark Fisher in Brooklyn in 2003 accused the prosecutor in the case Tuesday of putting up a questionable witness because she simply didn’t have anyone else.
Convicted killer John Giuca won a new hearing into his case after a review by the Brooklyn DA’s Office, which has been plagued by allegations of shoddy prosecutions.
Defense lawyer Mark Bederow suggested that then-prosecutor Anna Sigga-Nicolazzi called a jailhouse snitch — who has since recanted his testimony — to the stand at the last minute because the credibility of her other witnesses was waning.
He also demanded to know why Sigga-Nicolazzi didn’t disclose to the jury that she accompanied witness John Avitto to court after he absconded from a drug-treatment program.
“Do you think that you appearing in court on June 13, that that is something the jury should have had a right to consider?” Bederow asked.
“No,” she replied. “I believed [Avitto’s] story that he’d made so many mistakes over and over in his life and for once he wanted to do something right.”
