An unhinged upstate gun fanatic’s phone rants at Rep. Carolyn Maloney are not protected political speech, a Manhattan judge ruled Monday.
“[T]hat stupid c–t needs to stay away from my [S]econd [A]mendment right . . . I want that bitch dead,” screamed Ronald Buchanan, 40, of Elmira, in calls made on April 2.
The tirades were traced back to Buchanan, who was charged with harassment. He was allegedly upset by Maloney’s plans to sponsor legislation requiring liability insurance for gun owners.
Buchanan’s lawyers argued his words were protected political speech, but Manhattan Criminal Court Judge Erika Edwards said “threats” are not protected.
