Santa Claus is getting stiffed.

The family of “Santa Claus is Coming to Town” songwriter Haven Gillespie claims EMI — which owns foreign rights to the song — hasn’t passed on six-figure royalties from its use outside the country, said lawyer Robert Meloni, who represents them in a lawsuit filed in Manhattan federal court.

EMI declined comment.
