A judge could rule as early as next week whether the state Senate had the power to boot Hiram Monserrate via Tuesday night’s historic expulsion vote.

Manhattan federal Judge William Pauley III yesterday told lawyers representing Monserrate and the state Attorney General’s Office that he’d announce his decision before lawmakers return to Albany on Feb. 22.

Pauley, meanwhile, denied Monserrate’s request to block the March 16 special election Gov. Paterson has called to fill the northern Queens seat. A state Senate panel recommended the ouster after Monserrate was convicted of domestic violence.
