A judge Thursday denied bail for the eyeglass salesman — who once threatened to rape and murder a woman who complained about his shoddy wears — after he sent threats to a cooperating witness in a related case.
Vitaly Borker, 42 — who has a long history of scamming online customers and then threatening them when they complain or try to return his faulty products — asked to be released on bail while he awaits sentencing in his most recent case since his two-year sentenced on an older one ended Thursday.
But Manhattan Federal Judge Gardephe denied the request saying Borker, “has a well documented history of not being able to remain a law abiding citizen.”
Gardephe also said that a threatening Thanksgiving text message that Borker sent his co-defendant who flipped on him was “deeply deeply troubling.”
Borker texted Michael Voller about his testimony against him in a hearing last May: “Lying to the Court and Prosecutors while stealing from best friends isn’t going to work.”
Borker then implied Voller would get locked up for it.
“Next year will be filled with strip searches, visitation, corlinks, lockdowns, marshal transports, handcuffs & leg irons and of course many tears. Count on it.”
Borker was sentenced in 2012 to four years behind bars for threatening to rape and murder a customer who said she was ripped off by Borker’s business, DecorMyEyes.com.
Then in February 2018, Borker was sentenced to two more years in prison in the same case for lying to probation officers about a new scam following his 2015 release from prison.
Borker carried out the second scheme using a new website, OpticsFast.com, then harassing dissatisfied customers, in one case sending so many text messages to a customer that the man had to change his phone number.
Now — having served two prison terms — Borker awaits sentencing on April 24 for the second scam for which he faces up to 40 years behind bars, though under federal sentencing guidelines he faces far less time.
