A judge Monday refused to toss out the corruption case against New Jersey Sen. Bob Menendez, as the defense rested its case.
“The motion for a mistrial is denied and let’s get on with our trial,” said federal Judge William Walls.
Menendez’s lawyers were trying to get the case scrapped because the judge barred from inclusion evidence and witnesses — particularly former Hillary Clinton campaign lawyer and Trump-Russia dossier wrangler Marc Elias — that lawyers said could vindicate Menendez.
Following the judge’s decision, the defense rested after calling one final witness — meaning the embattled lawmaker will not have to testify in the case.
The sitting senator is accused of using his position to pull strings on behalf of Florida eye doctor and donor-pal Salomon Melgen in exchange for campaign contributions and Melgen-funded jaunts to the Dominican Republic and Paris.
Menendez and Melgen have maintained that the gifts arose not from a corrupt agreement, but out of their longtime friendship, which stretches back to 1993.
The Elias letter was supposed to explain away Menendez’s use of Melgen’s private jet.
Closing remarks are scheduled for Wednesday, and jury deliberations are expected to start later in the week.
