A Brooklyn federal judge yesterday tossed out a New York state lawsuit seeking to block hydrofracturing, saying it was too early to say whether the controversial drilling practice posed a risk to the water supply.

Judge Nicholas Garaufis ruled on procedural grounds, saying it was premature to determine whether extracting gas was harmful because regulations haven’t been drawn up yet.
