A Manhattan judge blocked the Civilian Complaint Review Board’s attempt to get confidential files on the city’s $6 million settlement to the family of Eric Garner, the Staten Island man who died after he was put in a chokehold by cops.

“The CCRB is not entitled to obtain access to the comptroller’s internal documents that were used to settle the subject wrongful death claim,” Manhattan Supreme Court Justice James d’Auguste wrote in his ruling released Wednesday.

But Judge Auguste said he will hold a private review of city comptroller hearings that are relevant to last summer’s seven-figure payout.

The CCRB, an independent city agency, wants the information as part of its ongoing police misconduct probe into Garner’s 2014 death

The CCRB sued the comptroller in October 2015 for access to the documents, which by law are not public.

The comptroller has the authority to settle legal claims against the city before they are filed in court.
