An upstate federal judge has shot down the state’s total ban on civilians using tasers, saying residents have the right to bear “electric arms” under the Second Amendment.
Judge David Hurd argued that while the state can restrict their use, it can’t just outright ban them — and besides, allowing people to arm themselves with tasers and stun guns could actually reduce deaths.
“Fewer handguns in the home would result in fewer injuries or deaths,” Hurd said, assuming people trade in their guns for tasers.
Forty-seven states currently allow tasers and stun guns under various forms of regulation, the judge noted.
