A cop who flunked a drug test after he says he unknowingly drank coca tea can’t have his job back, a Manhattan judge ruled yesterday.

Alvaro Casado tested positive for low levels of cocaine in 2009, a finding he blamed on his unknowing ingestion of Mate de Coca tea. He said the NYPD fired him from his job as a probationary cop as a result. He sued the department, hoping it would come to the same conclusion as his other employer, the Air National Guard, which found it to be a case of “innocent ingestion.”

Justice Salliann Scarpulla said because Casado was still a probationary cop, the NYPD had the right to let him go.
