ALBANY, N.Y. — Jury deliberations are scheduled to resume in the murder trial of a 20-year-old man charged in the fatal shooting of an Albany college student from Long Island.

The jury deliberated for more than five hours Monday night without reaching a verdict on the first-degree murder charge against De Von Callicutt, one of three men charged in the October 2008 shooting death of 22-year-old Richard Bailey of Wantagh.

Deliberations are set to resume Tuesday morning.

Authorities say Bailey, a University at Albany student and the son of a retired New York City police officer, was killed during a botched robbery as he walked home from a friend’s house.

The two other men with Callicutt the night of the shooting have both pleaded guilty to attempted robbery charges.
