NYPD Commissioner Ray Kelly is scheduled to appear in federal court today as a witness in a discrimination trial against his department.

The commish was named in a lawsuit filed by former NYPD Officer Howard Henderson, an African-American who claims he was unfairly targeted while at the department because of his race.

In 2000, Henderson was investigated by the NYPD for alleged involvement with drug dealers.

Henderson was cleared of wrongdoing. He retired and filed his suit in 2005.

Kelly was named in the suit because he signed a document approving Henderson’s return to duty.

Henderson claims his civil rights were violated, and he’s seeking unspecified damages.

Since leaving, Henderson has become a vocal advocate for curbing stop-and-frisk policies.

It’s unclear whether Brooklyn federal Judge Frederic Block will allow wider questioning of Kelly about the controversial policies.
