The US Court of Appeals in Manhattan yesterday refused to reconsider its previous ruling that had overturned the death penalty for a double-cop killer because of prosecutorial misconduct.

The previous decision had tossed the death-penalty sentence of Ronell Wilson — who executed undercover NYPD detectives Rodney Andrew and James Nemorin in a botched buy-and-bust in Staten Island in 2003 — because prosecutors attacked the sincerity of the convicted killer’s last-minute apology.
