The struggling actor who landed a part in jail for allegedly trashing the Ed Sullivan Theater has been indicted on charges stemming from the stupid human trick.

Investigators said James Whittemore went on a drunken rampage at the storied theater, home of “The Late Show with David Letterman.”

The lawyer for the 22-year-old says his client was so drunk, he doesn’t remember what happened during the incident early Sunday morning incident.

Prosecutors say he caused more than $5,000 worth of damage.

Whittemore’s alleged act spawned a sequel four days later, when Alvin Moore, 42, was busted for trying to break into the theater and trashing the front door with a newspaper box.
