A Brooklyn man accused of raping and robbing a woman a week after being bailed out by a non-profit on another case caught a break in court Tuesday.
Lynneke Burris, 30, had the charges against him in a completely different case — a Feb. 23 incident in which he allegedly punched a man and then stole his wallet — dismissed because the victim was unreachable.
Bronx Assistant District Attorney James Waller told the judge that a grand jury wasn’t able to indict Burris because of a “lack of cooperation from the complaining witness.”
Waller said his office wasn’t able to locate the victim so that he could testify.
The case was sealed and dismissed by a judge.
Burris is still due back in court Sept. 11 for the rape case, for which he faces up to 25 years in prison if convicted.
He was arrested in May for allegedly following a 23-year-old English teacher in her apartment building, then choking, raping and stealing from her on April 12.
Just a week before, the non-profit group The Bronx Freedom Fund sprang him from jail on $1,000 bail after he allegedly beat up a man and had crack on him.
Burris has a lengthy rap sheet, including an assault from March and numerous other sealed cases.
