A Michigan man faces up to five years in the slammer over a Facebook post that threatened the beheading of the NYPD cop cleared of criminal wrongdoing in the chokehold death of Eric Garner.
Alvaro Eduardo Guzman-Telles, also known as “Captain Acab,” allegedly wrote: “I’m going to personally kill and behead Daniel Pantaleo. This is a written threat and has to be taken extremely seriously.”
Papers filed in Detroit federal court say Guzman-Telles, 29, posted the threat sometime between Dec. 15 and 19, and deleted it after his mom warned him “that he could get in trouble.”
But before then, a tipster had already sent a screenshot to the FBI in New York, court papers say.
Mother Norma Telles told the feds her son traveled to Mexico by car on Dec. 19, and he was busted in Las Cruces, NM, on Jan. 7, court papers say.
Guzman-Telles has three handguns registered in his name, but no criminal record, court papers say. He has a bail hearing scheduled Friday in Detroit.
His father, Victor Guzman, told the Detroit News that his son has a history of autism and Asperger’s syndrome, and was just “venting” online.
Guzman also said he was in Mexico with his son, who voluntarily returned to the US to face prosecution.
“If there was some kind of will to do something, he wouldn’t have gone out of the country and come back knowing he was going to be detained,” Guzman said.
The younger man’s defense lawyer didn’t return a request for comment.
