A Brooklyn man is suing the city for civil-rights violations after spending a year in jail awaiting trial over alleged gun possession.
Officers Gregory Jean-Baptiste and Edward Babington told John Hooper to put his hands behind his back after seeing him put a bag into a trash can near his East Flatbush home, according to the suit. They would later claim they saw him drop a gun into the receptacle.
Hooper was eventually allowed to take a guilty plea for a sentence of time served after a year on Rikers Island.
He is now suing the city for civil-rights violations for an undisclosed sum in Brooklyn federal court, papers state.
The two officers are currently under investigation by the NYPD’s Internal Affairs Bureau, according to officials.
