More 2nd Ave. Deli-aching
The 2nd Ave. Deli may no longer be on Second Avenue, but it’s definitely located in New York, a new suit says.
Former deli owner Jack Lebewohl — who holds a 1987 trademark on the famed eatery’s name — filed a malpractice suit yesterday against a Miami lawyer he hired to shut down an alleged copycat sandwich shop in Florida.
Lawyer Jonathan Heller sent a “cease-and-desist” letter in 2000, but “never followed up with the infringer” — reportedly the Second Avenue Deli & Market of Deerfield Beach — who “has continued to infringe the trademark to the present day,” the suit says.
Heller called the suit a “grudge filing,” saying that he had a judgment against Lebewohl for “several thousand” dollars’ worth of unpaid legal fees.
