ALBANY — New York’s high court yesterday unanimously upheld the actions of the state Civil Service Department and Westchester County in recognizing same-sex marriages performed in other states.

The Court of Appeals, in a narrowly written decision, said same-sex marriages performed in other states can be recognized for purposes of state and Westchester County employee benefits as legal.

The court noted it was not legalizing same-sex marriage.
