ALBANY, N.Y. — New York’s top court has upheld the removal of a Westchester County judge, but says his brother and real estate partner can keep his Bronx judgeship.

The Court of Appeals it’s appropriate punishment to remove state Supreme Court Justice Joseph Alessandro for his handling of a $250,000 loan from his campaign manager, which wasn’t repaid as promised until she sued. The court found “a strong inference he was dishonest,” noting the debt was omitted from later loan and disclosure forms.

The judges say Tuesday an admonition is appropriate for Bronx Civil Court Judge Francis Alessandro, citing only “careless omissions” on his forms.

Paul DerOhannesian, Joseph Alessandro’s lawyer, says this ends the case and his client appreciates the decision that removal wasn’t warranted for his brother.
