A federal judge is allowing a lawsuit against New York City and the NYPD brought by two brothers falsely accused of selling drugs by undercover cops.
Prosecutors charged that two officers helped frame Jose and Maximo Colon during an undercover sting at a Queens nightclub last year.
One officer pleaded guilty. He filled out a written report describing a drug deal that prosecutors say never happened. The other officer pleaded not guilty.
A video from the club’s security cameras appears to back up the brothers’ story that they did nothing wrong. All charges against them have been dropped.
The brothers are suing for $10 million.
Police Commissioner Raymond Kelly says such cases are not the norm at the department.
