ALBANY — The Assembly and Senate passed legislation Thursday night making it illegal for cops to have sex with a prisoner.

The measure — approved within a series of budget bills — classified cop-prisoner relations in the same vein as sex with minors, the handicapped and others who cannot legally give consent.

Lawmakers were forced to act after it became known that there were no state statutes against cop-prisoner sex, following allegations that two Brooklyn detectives raped a handcuffed 19-year-old woman in their custody last September. The cops have pleaded not guilty to rape, claiming the sex was consensual.

Lawmakers, rushing toward the budget deadline, were also expected Friday to consider new fees for ride-share trips in Manhattan. The budget deadline is 12:01 a.m. on Sunday.

If pols can’t pass all the necessary budget bills, they’ll have to approve emergency spending measures to avoid a government shutdown. Lawmakers on both sides of the aisle have said they plan to leave Albany by sundown Friday in observance of Passover and upcoming Easter Sunday.
