Two New York men and a store can move forward with their lawsuit against Manhattan District Attorney Cyrus Vance Jr. over gravity knives, a federal appeals judge ruled on Tuesday.
The decision is a boost for John Copeland, an artist, Pedro Perez, an art dealer, and a shop called Native Leather, which was targeted in a knife sting. Their suit claims Vance wrongly arrested them over folding knives, which they claim are not gravity knives.
A lower court had originally tossed the suits against Vance in 2013.
A DA spokeswoman said the office would continue to fight the case.
