A Brooklyn filmmaker who accused her ex of poisoning her by slipping arsenic into her whitefish salad should be given back custody of their 4-year-old son, her lawyer argued Monday.

“She has never harmed Elliot,’’ said Robert Wallack, the lawyer for Galt Niederhoffer, referring to his client’s son in opening statements at her custody battle with her ex, Jonathan Gordon, in Brooklyn Supreme Court.
