The man stabbed as he ended an accused psycho killer’s bloody rampage reportedly plans to sue the NYPD.

Joseph Lozito, on his morning commute from Philadelphia to Lincoln Center, was riding a No. 3 at Times Square on Feb. 12 when he was knifed allegedly by Maksim Gelman, who has been charged with four murders.

Lozito’s lawyer said new evidence shows cops on the train locked the car doors rather than immediately coming to his client’s aid, according WPVI/Channel 6 in Philly.
