‘Rape cop’ phone twist
The drunken off-duty cop charged with raping a young schoolteacher at gunpoint on her way to work in Inwood this past summer is persisting in his “It was consensual” defense — even attempting to go through the woman’s cellphone records.
“There may not have been any [link], I don’t know,” defense lawyer Ephraim Savitt said after the ex-cop, Michael Pena, appeared in court yesterday.
Savitt said he got hold of the woman’s cellphone number when prosecutors mistakenly included it in a batch of documents they forwarded him in September.
The documents should have gone only to the judge.
Pena, 27, of the 33rd Precinct, remains held in lieu of $500,000 bail.
He returns to court Dec. 15, when pretrial hearings will be held.
