A Staten Island rehab center allegedly let a cancer patient die because of a forged “do not resuscitate” order, her husband claims in a lawsuit.

Carmel Richmond Healthcare and Rehab let Maureen LaCapria, 67, “deteriorate and die” because of a healthcare directive she allegedly signed – even though the paperwork had the word “void” written across it, husband Rocco LaCapria charges in Manhattan Supreme Court papers.

Maureen was battling stage four colon cancer earlier this year when she became ill from radiation treatment and was eventually sent to Carmel to recuperate, Rocco said court documents.

But instead of getting stronger, Maureen quickly declined. The center’s staff put her on oxygen, which resulted in the Staten Islander entering “a coma-like state,” Rocco LaCapria said in legal papers.

Rocco begged staff to send his wife back to the hospital but they allegedly declined, citing the directive, and refused to insert a feeding tube or try to revive her, he charges.

Someone forged his wife’s signature on the DNR order, Rocco charges in the $10 million lawsuit.

The facility was not aware of the complaint, a center spokesman said.
