Relatives of a Long Island man fatally shot in a confrontation with police have filed a federal lawsuit.

The family of Kevin Callahan claims Suffolk County police used excessive force when they shot him inside his Selden home last September.

The family said they had called police because they were worried about Callahan. He had been released a day earlier from Stony Brook Hospital, where he was treated for drug use.

Attorney Bruce Barket says the shooting was unjustified. He says Callahan did not have a gun when officers confronted him.

Police did not immediately comment on the lawsuit, which was filed Thursday in US District Court in Central Islip.

The lawsuit claims after Callahan was shot, he was handcuffed. He later died of his injuries.
