She gets to say nyet to jail time — for now.

Former Miss Russia Anna Malova, 39, who was busted in April for swiping a $10 hat and $135 sandals from a Union Square store while out on bail for a prescription-drug bust, will not go to jail, a judge ruled yesterday.

Instead, Malova, who had been facing petit larceny and criminal possession of stolen property charges, will have to enroll in a 12-month drug program in The Bronx.

If she completes it, all charges will be dropped.

In February 2010, Malova was arrested for allegedly swiping prescription pads from a psychiatric office to buy Vicodin.

In April, while still on the hook for that alleged crime, she was hit with a 44-count felony indictment involving painkiller prescriptions.
