A mother who is suing the Department of Education for $5 million claims her daughter “was impaled in the neck” by a pair of scissors hurled by a classmate in an out-of-control Bronx classroom, according to court papers.

Myriam Murphy blames employees at PS 24 in Riverdale for not controlling their charges on March 23, 2011, the day her daughter Caitlyn was injured, according to court papers.

“The student wasn’t impaled like we had to call an ambulance,” said Manny Verdi, assistant to the principal.

The city would not comment on the pending litigation.
