The Connecticut banker charged in the death of an Anguilla hotel worker is being sued by the man’s family.
The estate of Kenny Mitchel filed a complaint against Scott Hapgood in Connecticut federal court on Wednesday for intentional battery and negligence in the April scuffle that resulted in Mitchel’s death.
“Although the plaintiff’s decedent posed no risk to him, the defendant, without legal justification, intentionally and with reckless disregard for the safety of the plaintiff’s decedent, continued to apply pressure to his neck and to punch and hit him for more than one-half hour,” the suit says.
Kenny MitchelFacebookHapgood, 44, was charged with manslaughter but has insisted he acted in self-defense after Mitchel came to his room at the five-star Malliouhana hotel armed with a knife and demanding cash.
The Darien dad of three refused to return to Anguilla to face charges out of fear for his safety.
The suit says Mitchel, 27, who leaves behind a young daughter named Mylie, died of “prone restraint, positional asphyxia and blunt force trauma to head, neck and torso.”
A revised toxicology report showed Mitchel had a potentially lethal amount of cocaine in his system when he died.
His estate says it has incurred medical expenses and funeral and burial costs as a result of Hapgood’s “negligence.”
Hapgood could not immediately be reached for comment.
