A judge yesterday tossed out a lawsuit filed against Old Navy by a Lower East Side man who sells T-shirts emblazoned with his neighborhood’s name.

Robert Lopez had accused the clothing giant of ripping off his T-shirt idea.

He said in a deposition that his credibility “would be shot” if customers were to associate his tees with Old Navy products. But Manhattan federal Judge Paul Engelmayer said Lopez failed to prove “a likelihood of confusion” between the shirts.
