Two men are scheduled to be sentenced after they were convicted of beating an Ecuadorean immigrant to death.

Hakim Scott was convicted of manslaughter but acquitted of a more serious murder charge and Keith Phoenix was convicted of murder as a hate crime after a second trial. They were accused of breaking a bottle over the head of Jose Sucuzhanay (soo-KOO’-zah-nay) and then beating him to death.

They are set to be sentenced Thursday.

The victim and his brother were confronted in late December 2008 when they were coming home, arm-in-arm from a party. Prosecutors argued Scott and Phoenix targeted the brothers because they thought they were gay.
