Lawyers for pharma felon Martin Shkreli filed a motion Friday asking the judge to drop one of the three counts he was convicted of last month, claiming jurors were unfairly swayed by prosecutors’ statements.

Defense attorney Ben Brafman asked Brooklyn federal judge Kiyo Matsumoto to acquit his client of the charge of “conspiracy to commit securities fraud,” alleging prosecutors themselves are guilty of “creating a false definition of the term “affiliate” and then misapplying it to the facts.”

“Having heard the Government repeatedly misstate this critical legal definition and how it applied to the specific facts underlying Count 8, the jury had almost no choice but to convict Shkreli,” the filing reads.

In count 8, prosecutors claimed Shkreli secretly took control of shares in his pharmaceuticals company, Retrophin, in an attempt to manipulate the stocks market price.

Meanwhile, Matsumoto ordered Shkreli to appear in court on Sept. 13, to determine whether or not to throw him behind bars after his online harassment of former Secretary of State Hillary Clinton.

Shkreli, 34, faces up to 20 years behind bars when sentenced.
