A New York City bus driver who hit and killed a pedestrian on his first day back from a texting-while-driving suspension has been issued a traffic ticket.

Police charged 39-year-old Jeremy Philhower of Staten Island with failing to yield to a pedestrian in the fatal Nov. 4 accident.

The victim was 22-year-old Seth Kahn, of Mamaroneck, who was hit by the back wheels of the turning bus in Manhattan.

Police say the bus had a green light and Kahn had a walk sign.

NYC Transit had suspended Philhower earlier this year for texting while driving.

Police spokesman William Winning says the NYPD’s accident investigation section issued the summons. NYC Transit is conducting its own investigation.
