A judge Monday denied a request by a defendant to exclude crucial evidence from a gun-possession arrest because slain NYPD Officer Randolph Holder was the lone witness person to testify he had seen the weapon, a report said.

Justice Charles H. Solomon of State Supreme Court in Manhattan said the fact that Holder informed his commanding officer about seeing the weapon was enough evidence to make the case lawful, The New York Times reported.

in the case, Brandon Waters, 25, is accused of dumping a loaded revolver in front of Holder in East Harlem on Halloween 2014,

Holder was fatally shot in the head on Oct. 20 allegedly by drug dealer Tyrone Howard.
