A jury was selected in Brooklyn Supreme Court yesterday to hear the case against a cop accused of sodomizing a suspect with a nightstick.

Officer Richard Kern is charged with violating Michael Mineo after he and other officers spotted Mineo smoking pot outside a subway station in 2008.

Two other cops, Alex Cruz and Andrew Morales are accused of helping Kern cover up the attack.

During jury selection, defense lawyers said Mineo has a criminal record and has filed a $440 million suit against the city.

Prosecutors promised that DNA evidence and testimony from another cop would support their case.
